Law needs upheld. If the officers are exempt from damages caused in the line of duty, the judge will drop it-Simms is competent and fair. I dont see the big deal, if plaintiff wont drop, judge will dismiss.

I don't get what this is all about. Why would the city care if the plaintiff drops the suit if the city is protected by the law and the case will be dismissed anyway? As a disinterested third party the plaintiff should be entitled to restitution, however, the motel should have insurance?

"City is protected by law" There are good and bad laws. What protects citizens property from this type damage? Will insurence cover this?

Hefner-I dont understand either. I am guessing motel has deductable like most homeowners. If the police came and busted my door down (say had the wrong house), I would certainly expect the city to pay for damages. Im afraid that I might find out that if it is an honest error to save someone or make an arrest, the city is not liable for the damage they cause in their pursuit. I know someone who's apartment was raided (had the wrong apt.-resident told cops warrant was for man with different color skin) but they told him to shut up and tore it up anyway, ripping furniture and mattresses. They paid no restitution. My understanding is-tough luck. Doesnt seem right but if its the law-cant fight it.

Collins should be the first held liable for any damages. After him then insurance, either the city or Motel owner.

Why should the property owner foot the bill on this?He is not at fault.The police should have insurance to cover damages to third parties.

OK, I really do not understand WHY the police department should not pay for these damages. Let's play Devil's advocate: WHAT IF the perp was NOT in the room and they busted in the door? What then? Would they be liable for damages? I am seeing more and more of these cases where police are busting down door frames of houses, looking for people and/or drugs and then finding out, "Whoops, wrong house, sorry!" - and NOTHING HAPPENS!

The report states 'only slight damage". Wonder Ward must have wrote that. I thought maybe he was in hot pursuit to arrest one of his girlfriends so he could post her on facebook. Class-less cop.
